Hereinafter referred to as "the Seller" or "ARTEZ".

Article 2 — Purpose and scope

Les présentes Conditions Générales de Vente (CGV) régissent les ventes de spiritueux et boissons alcoolisées (Armagnac, Absinthe, Pastis, Floc de Gascogne, liqueurs) réalisées sur le site www.artez-spiritueux.com auprès de consommateurs majeurs résidant en France métropolitaine.

Any order placed on the site implies the unconditional acceptance of these T&Cs by the customer.

Article 3 — Sale of alcohol and age verification

In accordance with French legislation (article L3342-1 of the Public Health Code), the sale of alcohol to minors under 18 years old is prohibited..

By placing an order, the customer certifies that they are at least 18 years old. ARTEZ reserves the right to request proof of age at any time, particularly upon delivery, and to refuse or cancel any order if there is doubt about the customer's age.

Excessive alcohol consumption is dangerous to health, to be consumed in moderation.

Article 4 — Products

The products offered for sale are those listed on the site at the time of consultation, within the limits of available stock. ARTEZ reserves the right to modify the range of products offered at any time.

The photographs and descriptions of the products are as accurate as possible but cannot guarantee an exact similarity with the delivered product, particularly regarding vintages and natural variations related to the craftsmanship.

Article 5 — Price

Prices are indicated in euros, all taxes included (TTC), excluding delivery charges which are specified before the final validation of the order.

ARTEZ reserves the right to modify its prices at any time, it being understood that the price listed on the site on the day of the order will be the only one applicable to the buyer.

Article 6 — Order

The customer selects the desired products, adds them to their cart, and then confirms their order after verifying its contents. The order is only final after payment confirmation and the sending of a confirmation email by ARTEZ.

ARTEZ reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding the payment of a previous order, or in case of doubt about the customer's legal age.

Article 7 — Payment Terms

Payment is due immediately upon ordering. Accepted payment methods are indicated on the site at the time of payment (credit card and other online payment methods offered by our secure payment providers).

Transactions are secured by our payment providers. ARTEZ does not store any customer banking data.

Article 8 — Delivery

Delivery area: ARTEZ only delivers in mainland France.

Delivery times are indicated as a guideline at the time of ordering and may vary depending on product availability and the carrier. ARTEZ cannot be held responsible for delays attributable to the carrier.

Age verification upon delivery: in accordance with article 3, the carrier may be required to ask for an ID at the time of delivery to verify that the recipient is of legal age. Any order that cannot be delivered due to age verification may be returned to the sender at the customer's expense.

Article 9 — Right of withdrawal

In accordance with articles L221-18 and following of the Consumer Code, the customer has a period of 14 days from the receipt of the products to exercise their right of withdrawal, without having to provide a reason.

To exercise this right, the customer must notify their decision to ARTEZ by email or mail before the expiration of the period, and then return the products in their original condition, unopened and unused, within 14 days following the notification.

Return shipping costs are the responsibility of the customer, unless an error is attributable to ARTEZ. Refunds will be processed within 14 days following the receipt of the returned products or proof of their shipment.

Note: the right of withdrawal cannot apply to unsealed or opened products for hygiene reasons 

Article 10 — Legal warranties

All products sold by ARTEZ benefit from the legal warranty of conformity (articles L217-3 and following of the Consumer Code) and the warranty against hidden defects (articles 1641 and following of the Civil Code).

In case of non-compliance of a product, the customer may request its replacement or refund, at no cost.

Article 11 — Liability

ARTEZ cannot be held responsible for the non-performance of the contract in case of force majeure, stock shortages, or events attributable to the customer or a third party.

The consumption of alcohol is solely the responsibility of the buyer, in accordance with the applicable legislation.

Article 12 — Personal data

Article 13 — Intellectual property

All elements of the site (texts, images, logos, brands) are the exclusive property of ARTEZ or its partners. Any reproduction without prior authorization is prohibited.

Article 14 — Disputes and mediation

In case of a dispute, the customer may resort free of charge to a consumer mediator, in accordance with article L616-1 of the Consumer Code. 

These general terms and conditions are subject to French law. In the absence of an amicable resolution, any dispute falls under the jurisdiction of the French courts.
